Injured While Shopping?
As hard as it is to believe, injuries are occurring to shoppers in large super stores such as Home Depot and Walmart. How are consumers injured while shopping? From falling items stacked high above their heads. These big box retailers place merchandise on shelves way above the heads of unknowing customers --- things such as timber, kitchen sinks and other extremely heavy items. When they fall, these poor customers don't even realize what hit them. In several cases over the past few years, people have died as a result of a corporation's negligence. The federal Occupational Safety and Health Administration monitors employee safety, but doesn't investigate or record customer injuries and deaths at these stores. So next Saturday morning when you go to the large super hardware store for a few household items, watch out from above.
What might an injury to neck and back resulting from this be worth?
Amy: It's extremely difficult to state what measure of compensation would be warranted. We never give our clients a dollar figure as to what we think a case is worth because every matter is different and dependent on the circumstances. For example, where did the injury occur; is the injured person an employee of the store or a customer; what are the extent of the injuries --- are any of the injuries permanent in nature; did the customer contribute to his or her injuries in any way; did the customer have preexisting injuries; and a host of other factors should be considered. My wife was shopping at a Wal-Mart in Central New York. She was hit on the head by a falling 15 pound box. She was taken to the hospital emergency room via ambulance. Meanwhile medical bills have reached $10,000.00 and Wal-Mart says they are not responsible for any of it.
My wife suffers from a severe neck trauma. Problems with neck, back and arms . Wal- Mart says they have no insurance coverage for customer injuries?What do you think. ?
I work in retail and I know that we are required to keep a log of spill clean ups and sweeps in case a customer slips and falls. But the problem is they log an entry 4 times an hour weather or not there was really a clean up or sweep. That sounds illegal to me. Sounds like falsefying documentation. what can be done to stop this?
